Why should businesses and property management companies use WHS Consultants Pty Ltd?

The new Work Health and Safety Act and Regulations introduced into Australia mirror the safety regulations that came into effect in the UK and Europe throughout the 1990s.  Western Australia was one of the last jurisdictions to pass their Work Health and Safety Act 2020 late in 2021 with the Regulations commencing early 2022. These largely replace the previous Occupation Health and Safety Acts in each state, are more prescriptive and contain criminal penalties for non-compliance.

The Senior Consultants in our Company advised many businesses throughout the UK and Europe and can use this experience, learned lessons, systems and proven technology to ensure the most effective and workable solutions are provided for your business. The regulations maybe new in Australia, but they are based on legislation that has been in place for decades elsewhere.

Work Health & Safety compliance for managed properties involves general risk assessment as well as specific requirements for asbestos, water quality, plant and equipment and management of contractors. We provide a holistic approach dealing with all of these issues at the same time.

How would you set out to advise and assist a PCBU?

The Parliament of Western Australia in 2020 passed through the Work Health and Safety Act 2020 (WHS Act) which took effect from 31st March 2022.

WHS Consultants advise people who control businesses and properties on how to establish and manage systems and disciplines that comply with Work Health and Safety Act & Regulations and ensure that ‘best practice’ is achieved.

It is essential to understand under the WHS Act that a Person Conducting a Business or Undertaking (PCBU) has a primary duty to ensure the health and safety of workers while they are at work in the business or undertaking, and others who may be affected by the carrying out of work, such as visitors and contractors.

We help businesses to train and work with their existing staff or provide a complete remote assistance package.

What is DataStation?

DataStation has been assisting companies around the world to manage their WHS obligations since 2004.

Contractors can carry out statutory maintenance on assets and then upload their evidence and record any required actions. These actions in turn can be managed and closed out by whoever is responsible within the organisation in real time.

Maintaining asbestos registers on DataStation makes it easier and safer for contractors to review before a site visit. Also, the requirements to have it available for inspection and pass it on to a new tenant or owner is easily managed on DataStation.

Services we provide include:

  •  Review of current WHS policy and procedures with gap analysis. Write new policy and procedures or augment existing to achieve a workable WHS system that complies with the regulations.

  • Short (30mins) regulatory overview for property managers, outlining main responsibilities and how to protect the company and its employees from liability issues due to potential non-compliance with the WHS Regulations.

  • 2 hour (1 CPD point) or 6 hour (3 CPD points) training for Property Managers and PCBU’s covering all aspects of the WHS regulations as they apply to commercial real estate. (Approved training provider).

  • Health & Safety Risk Assessments of property and workplaces to identify hazardous structures, plant and equipment and work practices. Provide safe working systems where needed.

  • Asbestos survey, register and asbestos management plans on properties built before 31st Dec 2003.
